Legal Requirements for US citizens getting married in Italy.
In order to get married in Italy you need a Nulla Osta (Certificate of No Impediment).
To obtain a Nulla Osta, according to Australian regulations, you need to forward
the following to the Australian Embassy in Rome or the Australian Consulate-General
in Milan:
- If previously married, you must also present your final divorce decree
(if applicable), or death certificate of the previous spouse. These must also
be certified with an “Apostille”.
If the woman has been divorced less than 300 days from the proposed wedding
date, it is not possible to have a civil ceremony in Italy.
- Atto Nottorio (to be done in the States or in Italy but we prefer it be
done in the US unless time does not permit.) Is a declaration sworn by 4 witnesses
before an Italian Consular Officer stating that there is no obstacle to his/her
marriage. You must call your nearest Italian Consulate and set up an appointment
for this to be done. Ask how many witnesses are needed. IMPORTANT: This can
not be issued more than 3 months before the wedding otherwise it will expire.
